The Ministry of Health (MOH) recently released a third draft version of a decree to establish a legal framework for managing and developing medical data, creating a National Medical Database, and implementing electronic health records. This decree is open for public feedback until August 3, 2024.
The Draft Decree consists of four chapters and 29 articles. This third draft defines medical data broadly, including medical examinations, treatments, preventive medicine, traditional medicine, pharmaceuticals, medical equipment, food safety, reproductive health, and health insurance.
The proposed National Medical Database will contain information on medical facilities, devices, pharmaceuticals, and personal health, and will be managed by the MOH. The Draft Decree specifies the roles and responsibilities of state agencies, data subjects, and related entities in handling medical data. It permits organizations and individuals to utilize the data according to their registered functions with the MOH. However, it does not detail the registration process further.
This decree is expected is come into effect by the end of 2024. This initiative supports the Prime Minister’s “National Digital Transformation Program to 2025,” aiming for comprehensive digital transformation in the medical field.
